      This mare is booked specifically by name. The booking is valid to the mare named and may not be transferred without the consent of Hickory Ridge Farm. Breeding season opens Feb. 15th and closes July 15th. Hickory Ridge Farm must be notified at least twenty-four (24) hours in advance when a mare is to leave the farm. Hickory Ridge Farm reserves the right to reject any mare not in good physical condition that Hickory Ridge Farms determines, at its sole discretion to reject.

      All risk of loss of horse, mare, or her offspring, whether from injury, illness, accident or otherwise, is assumed by owner/agent and neither Hickory Ridge Farm nor its officers, directors, partners, owners, agents, or employees shall have any liability to owner/agent, their heirs, transferees, assigns or beneficiaries, whatsoever arising from or relating to the care and custody of such horse, mare or her offspring by Hickory Ridge Farm, except upon gross negligence or willful misconduct.

     Owner/agent acknowledges that the Indiana Equine Activity Statute I.C. 34-4-44, shall apply to this agreement. In furtherance of said statute: “Under Indiana law, an equine professional is not liable for an injury to, or the death of, a participant in equine activities resulting from the inherent risk of equine activities.”

     Service fee above does not include transportation, veterinary expense, board or other expenses. The service fee is due and payable when the mare produces a live foal or ownership thereof changes, whichever comes first. A live foal is one that is able to stand up alone and nurse. If the stallion is removed from Hickory Ridge Farm or in any manner becomes unfit for breeding before serving the mare or the mare dies or otherwise becomes unfit to be bred, this contract is and shall be null and void. A stallion collection fee of $65, a $35 fee for the shipping container (unless returned or furnished by the mare owner/agent) and shipping charges as determined by the carrier will be charged for each semen shipment. Please notify the farm by 10:00 am ESDST for same day shipment offered by carrier. Collection days Monday, Wednesday, Friday, Saturday.

     All charges including transportation, veterinary fees, board, ect. Are to be paid monthly by the owner/agent of the mare on or before the tenth of the succeeding month. Hickory Ridge Farm requires a deposit of $150 or credit card information on file before semen will be shipped. A 1.5% monthly service charge will be added to any balance over thirty (30) days old. All sums owing to Hickory Ridge Farm, whether as fees hereunder or pursuant to any other agreement must be paid before the mare, and/or her offspring may be removed from the farm. Hickory Ridge Farm is hereby granted an irrevocable first priority lien upon the mare and her offspring as security for owner/agent performance hereunder. Owner/agent agrees to pay all cost incurred in collection of unpaid fees hereunder, including reasonable attorney fees.
